SWEEPSTAKES PRIVACY NOTICE

PERSONAL INFORMATION PRIVACY NOTICE:By completing the form to enter the Sweepstakes you will be providing to us personal information such as your name, email address, telephone number and state of residence. This information may be used

(i) to verify your eligibility to enter the Sweepstakes, (ii) to contact you to receive a Prize if you are chosen as a winner or (iii) to post your name and state of residence on our website(s) if you are chosen as a winner. This information may also be used to send you information about our company or our products or services, or to contact you when necessary. For further information about our practices and your rights regarding your personal information, please see our Privacy Policy.

SWEEPSTAKES RULES

Sweepstakes Sponsor:Catalina Industries, Inc., a California corporation (referred to herein as “Catalina”), is the sponsor of the Catalina Paint Summer Giveaway (“Sweepstakes”) described in these Sweepstakes Rules and Privacy Notice (these “Rules”).

Eligibility:This Sweepstakes is open only to individuals (“Entrants”) who are residents of the California and are or will be at least 18 years of age at the time of entry. If you are not a resident of California or you will not be 18 of the time of entry, you are not eligible to enter the Sweepstakes or to win a Prize. To be eligible to win a Prize, entries must be completed and received by Catalina as described below. Directors, officers, and employees of Catalina and any of its affiliated and successor companies, its or their professional advisors, advertising and promotional agencies, and Sweepstakes partners and prize suppliers, and immediate family members of any of them, are not eligible to participate. “Immediate family members” includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as “in-laws”, or by current or past marriage, remarriage, adoption, co-habitation or other familial extension, and any other persons residing at the same household location, whether or not related. All applicable federal, state and local laws and regulations apply. Sweepstakes void where restricted or prohibited by law.

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

Odds of Winning:Odds of winning will be determined by the number of eligible entries received. Odds of winning are estimated to be 1:20,000 depending on participation. Odds may differ based on participation.

Sweepstakes Period:The Sweepstakes shall commence on April 10, 2023 at 12:00 a.m. Pacific Daylight Time and shall end on August 20, 2023 at 11:59 p.m. Pacific Daylight Time (the “Deadline”). All entries must be received during this time period (the "Sweepstakes Period") to be eligible to win a Prize. Any entries not received during the Sweepstakes Period will not be eligible, and such entries will not be considered. Catalina also reserves the right in its sole discretion to suspend or cancel the Sweepstakes or any Entrant’s participation in the Sweepstakes should causes beyond the control of Catalina corrupt the administration, security or proper play of the Sweepstakes or if Catalina otherwise becomes (as determined in its sole discretion) incapable of running the Sweepstakes as planned.

Prizes:There will be five (5) Prizes of $1,000 each (each a “$1000) and a Grand Prize of $10,000.00(the “Grand Prize”). The specifics of all aforementioned elements of the Prizes shall be solely determined by Catalina. No substitution or exchange of a Prize or cash payment in lieu thereof will be permitted, except that Catalina reserves the right to substitute a prize of equal or greater value for a Prize or any portion thereof. The Prizes are not assignable or transferable. THE PRIZES WILL BE AWARDED “AS IS” AND WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, (INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE).

How to Enter:You may enter by completing the Sweepstakes Entry Form which is available at any of our retail stores or on our website at www.catalinapaint.com. Locations of our retail stores are available on our website. You may submit an entry more than one time but not more than one time per day. Sweepstakes Entry Form will require that you provide us with your name, address or email address, telephone number, your affirmation that you are a resident of California and are 18 years or older and your agreement to these Rules. You must complete the Sweepstakes Entry Form in order for your entry to be eligible. Incomplete entries will be disqualified. No purchase of any Catalina products is necessary to enter the Sweepstakes. Purchase of Catalina products will not improve chances of winning.

Entries:Use of any automated system or agent to submit entries is prohibited and will result in disqualification. In the event of a dispute as to any entry, the authorized account holder of the e-mail address used to enter will be deemed the entrant. The "authorized account holder" is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder.

Disclaimer:Catalina and its affiliated and successor corporations, their directors, officers, shareholders, employees and other agents, will not be responsible for: (a) entries that are incomplete, late, lost, illegible, misplaced, misdirected or mutilated; (b) telephone, electronic, hardware, software, network, or other computer-related or communications-related malfunctions or failures; (c) any Sweepstakes disruptions, injuries, losses or damages caused by events beyond the control of Catalina; or (d) any printing or typographical errors in any materials associated with the Sweepstakes. Catalina shall not be responsible for the quality or adequacy of the Prizes or any portion thereof or the products or services to be provided to the Prize winners. Catalina will not be responsible or liable for loss or injury resulting from Entrants entering the Sweepstakes, or from the winner’s acceptance or use or misuse of the Prizes or any portion thereof. The winner of the Grand Prize will be required to sign a liability waiver. By submitting an entry, all Entrants accept and agree to these Rules and the decisions of Catalina in administering the Sweepstakes, which shall be final. The winner assumes complete liability for damage to property or injuries to the winner and his or her guests or invitees caused or claimed to be caused by participation in the Sweepstakes, or the use or misuse of the Prize or any portion thereof.

Selection of Winner:Winners shall be chosen by Catalina in random drawings as follows: On September 2nd at or about 12:00 five (5) winners of the $1,000 Cash Prizes (the “Cash Prize Date”) will be chosen at random from among eligible entries received during the Sweepstakes Period. The Grand Prize winner will be chosen thereafter. The choice of the winners by Catalina will be final. Each winner may only win one Prize. If the same entrant is initially drawn as the winner of more than one Prize then the entrant will receive one Prize and an additional drawing or drawings will be conducted to choose the winner of the excess Prize(s).

Winner Notification/Prize Awards:Catalina will send notifications to winners within three (3) days of the applicable Prize Date. Notification will be sent by e-mail to the e-mail address listed on the entry form. If Entrant has no e-mail address and provides a physical address instead, notification will be by overnight mail by FedEx or similar delivery service. To accept the Prize, the winner should follow the instructions given by Catalina in its notification. As a condition of being awarded the Prize, the winner will be required to execute and deliver to Catalina a signed Declaration of Eligibility, which includes a certification of age and residence, acceptance of these Rules, a name/image/likeness/voice release and a release of liability. The winner must provide his or her social security number or other taxpayer identification number if the value of the Prize exceeds $599. The winner must sign and return these documents within three (3) days of transmission (if by email) or delivery (if by overnight mail) of the notification or his or her right to the Prize shall be forfeited and Catalina will select an alternate winner. Prizes will be awarded within fourteen (14) days of receiving required documents noted above. Return of any notification as undeliverable will result in disqualification and an alternate winner will be drawn.

Taxes:All federal, state and local taxes (including any sales taxes) associated with the receipt or use of a Prize will be the sole responsibility of the winner if the Prize. The winner may receive an IRS form 1099 at the end of the calendar year if the value of the Prize is within IRS guidelines, and a copy of such form will be filed with the IRS. Any additional costs relating to the Prize, and incurred as a result of accepting the prize, are the sole responsibility of the winner.

Disclosure of Winner:The identity and state of residence of the Entrants chosen as the Sweepstakes winners may be disclosed on the Catalina website at www.catalinapaint.com, social media and other marketing and promotional materials.

General Release:By entering the Sweepstakes, you release Catalina and its affiliated and successor corporations, their directors, officers, shareholders, employees and other agents, professional advisors, advertising and promotion agencies, Sweepstakes partners and Prize suppliers from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Sweepstakes or the delivery, misdelivery, acceptance, possession, use of or inability to use the Prize or any portion thereof (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.

Miscellaneous:The Sweepstakes and these Rules will be governed, construed and interpreted under the laws of the California. If any provision of these Rules is declared to violate any federal, state or municipal law, it shall be amended to conform to such law and all other provisions shall remain in full force and effect. Entrants agree to be bound by these Rules and by the decisions of Catalina, which are final and binding in all respects. Entrants who violate these Rules, tamper with the operation of the Sweepstakes or engage in any conduct that is detrimental or unfair to Catalina, the Sweepstakes or any other Entrant (in each case as determined in Catalina’s sole discretion) are subject to disqualification from the Sweepstakes.
